Irish Supreme Court to Decide Whether to Accept Facebook Appeal

Ireland’s Supreme Court is set to decide whether it will hear Facebook’s appeal against a decision by the High Court’s to refer key issues on the validity of data-transfer channels between the European Union and the United States to the European Court of Justice.

The US tech giant says that it has the right to appeal both the reference itself and certain findings of fact by the High Court’s Ms Justice Caroline Costello grounding the reference which the company says are wrong. Facebook’s Paul Gallagher also argued that the exceptional circumstances and far-reaching consequences of the case which will affect EU-US trade, means the Supreme Court should hear such an appeal.
