Wendy’s Sued for Breaking BIPA Law

Fast food chain Wendy’s is facing a class action suit in the state of Illinois for unlawfully collecting and storing employee fingerprints.

Filed last September 11, the complaint says that Wendy’s had violated the Illinois Biometric Information Privacy Act (BIPA) for not adequately informing its employees about how their data is handled. The plaintiffs said that they were required to use fingerprint scanners whenever they arrive and leave for work, or user POS and cash registers.  

Included in the class action is Wendy’s biometric software provider, Discovery NCR Corporation, which the complainants say may have additional biometric information on the employees.
